His legal team believes that the U.S. entered into a quiet agreement with Salvadoran officials to incarcerate deportees in exchange for financial compensation.
A Court Victory, a Political Standoff
In April 2025, the U.S. Supreme Court unanimously ruled Kilmar’s deportation unlawful. Justice Sotomayor, writing for the Court, called out the government’s argument that it could avoid legal consequences by acting faster than the judicial system. Although the ruling required the U.S. to facilitate Kilmar’s return, it stopped short of demanding it. Officials interpreted this as a minimal obligation — offering him reentry and a plane ticket, but taking no further action. Salvadoran President Nayib Bukele has refused to release Kilmar, publicly branding him a terrorist despite no conviction and no trial. Kilmar remains imprisoned in one of the world’s harshest detention facilities.
